General Terms and Conditions

1. Ownership: All photographs, images, videos, and content created by Light House Media, including but not limited to real estate photography and videography, virtual tours, and any other related media, are the exclusive property of Light House Media.

2. Usage Licence: The primary listing agent is granted a non-exclusive, non-transferable licence to use the photographs and videos for the purpose of marketing the specific property depicted in the images. This licence is limited to the duration of the active listing period and is subject to the terms outlined herein.

3. Additional Licensing: Any use of media outside the scope of standard property marketing (e.g., portfolios, editorial publications, websites unrelated to the specific listing) requires prior written permission from Light House Media and may incur additional licensing fees.

4. Restrictions: Clients are prohibited from sub-licensing, selling, or otherwise transferring the licence or usage rights to any third party without the express written consent of Light House Media. Images and videos may not be altered, edited, or manipulated in any way that would compromise the original artistic intent created by Light House Media. This is at the discretion of Light House Media.

5. Additional Usage: Any usage of the images or videos beyond the specified marketing purpose, including but not limited to commercial, editorial, portfolios, or promotional use, requires written permission from Light House Media. Additional fees may apply.

6. Ownership Acknowledgement: Light House Media retains copyright ownership of all media. Acknowledgment is not required for standard listing marketing purposes. However, if additional licensing is granted for uses such as portfolios, editorial publications, or social media campaigns unrelated to the specific listing, acknowledgment may be required as part of the terms of the additional licence.

7. Exclusivity: Unless otherwise agreed upon in writing, Light House Media retains the right to use the photographs and videos for self-promotion, portfolio, marketing, and any other purposes.

8. Termination of Licence: Light House Media reserves the right to terminate or modify the licence granted to the client in case of breach of these terms and conditions.

9. Governing Law: These terms and conditions are governed by the laws of Queensland, Australia, and any disputes will be resolved in accordance with those laws.

10. Matterport Virtual Tours: Matterport tours will be hosted until the property is sold, or with a maximum of 6 months. Once the hosting time expires, the client is responsible for any desired permanent media storage. Additional hosting is available upon request, and fees may apply.

First Shoot Promotion

Light House Media offers new real estate agent clients a special on the “House" promotion for their first booking. Choose from a 10-photo shoot, 5 drone photos, or a 2D colour floor plan for free (a $150 value).

Alternatively, enjoy $150 off any order above $150.

1. The promotion applies to your first order only and is limited to one offer per client.

2. The minimum booking amount is $150, in order to get the $150 off.

3. Trip fees and additional services are charged as normal.

4. Light House Media reserves the right to modify or withdraw this promotion at any time without prior notice.

Cancellations and Property Readiness

1. Cancellations:
   Appointments canceled with less than 24 hours’ notice will incur a $100 cancellation fee.

2. Getting Ready Guide:
   Clients are strongly encouraged to review and utilize our Getting Ready Guide to ensure the property is prepared for the shoot. This guide provides valuable tips for making the home photo-ready, particularly if a professional staging company is not being used.

3. Weather-Related Reschedules:
   Severe weather conditions, such as storms, heavy rain, or other unsafe circumstances, may require rescheduling. In these cases, no rescheduling or call-out fee will be applied. However, if the weather allows for interior-only shots, the client may choose to proceed with the interior shoot as scheduled.

4. Emergency-Related Reschedules:
   In the event of unforeseen emergencies that are beyond the control of both the client and Light House Media—such as power outages, natural disasters, or other exceptional circumstances—reschedules will be accommodated without any additional fees.

5. Property Readiness and Rescheduling Fees:                                          If the property is not ready upon the photographer's arrival, or if there are any preventable conditions (such as, but not limited to, locked properties, unready homes, or unexpected trades) that delay the shoot by 30 minutes or require rescheduling, the client will be subject to a $50 call-out/reschedule fee plus applicable travel fees.

Order Details & Accuracy

​

1. Square Metre Accuracy: Where required, the client is expected to have accurately entered or communicated all pertinent information at the time the order is placed. We reserve the right to update incorrect information and adjust the pricing of the order to reflect the correct details (e.g., if the client states the property is 130 m2 but it is actually 220 m2). Invoices will be adjusted accordingly.

2. Scope of Work: Our pricing reflects the cost for a residential listing. For commercial or multi-unit properties, please contact us for a personalised quote.

3. Travel Ranges and Fees: Travel is free within a 30 km one-way radius. For distances beyond that, additional fees apply. A fee of $2.50 per km is charged for every km over 30 km one-way, in addition to the following: $30 for 31-60 km, $60 for 61-80 km, and $20 for every 20 km beyond that. Standard travel fees are the first thing automatically calculated online, based on the address' one-way distance, and must be agreed to before proceeding with the booking.​​

4. ​Travel to Islands: For properties located on islands off the East coast, additional travel fees apply. While the standard travel fee is automatically calculated during booking, it does not account for the extra time and expenses required for ferry transport. Light House Media will contact you with a finalised travel fee to accommodate for these additional costs. These bookings will only be confirmed once the finalised fee is approved.

Standard Travel Fee Examples (Fee + KMs):

33km: $30 + $7.50 = $37.50

47km: $30 + $42.50 = $72.50

63km: $60 + $82.50 = $142.50

Oversized Scans and Floor Plan Fees

​

For properties exceeding standard size limits, oversized scan fees apply. These fees are determined by the total square metres scanned, not just the total living square metres. This includes all scanned areas such as walls, garages, alfrescos, or any additional spaces included in the scan.

• 2D Floor Plan Products:

  • Properties 465-697m²: $75

  • Properties 697-929m²: $150

  • Properties 929-1161m²: $225

• 3D Floor Plan Products:

  • Properties 465-697m²: $180

  • Properties 697-929m²: $360

  • Properties 929-1161m²: $540

These fees are in addition to standard pricing and reflect the increased time and resources required for larger properties. If the client provides inaccurate property size (or no size at all) during booking, any applicable oversized fees will be added to the final invoice based on the actual size scanned.

By placing an order, the client acknowledges and agrees to these fees being added when applicable. 

Changes to Terms and Conditions

Light House Media reserves the right to update or modify these Terms and Conditions at any time without prior notice. It is the responsibility of the client to review the Terms and Conditions before each booking.

By continuing to use our services, the client agrees to be bound by the most current version of the Terms and Conditions.
